New England tight end Rob Gronkowski will have back surgery on a disk in mid-June.

A person familiar with the decision told The Associated Press on Wednesday that Gronkowski will undergo the surgery next month, which means he will miss the rest of offseason training activities with the Patriots. He could return for training camp at the end of July.

The person spoke on condition of anonymity because the Patriots do not reveal injury details publicly.

Gronkowski missed the 2009 season at the University of Arizona after back surgery. Earlier this month, he underwent a fourth procedure on his left forearm, which he broke last season, to treat an infection.

He broke the forearm Nov. 18 while blocking for an extra point against the Indianapolis Colts. He broke it again early in the Patriots' first playoff game, a win over Houston, ending a rough season for the star tight end.

Gronkowski had 55 receptions and 11 touchdowns despite missing five of the 16 regular-season games last year. The previous year, he had 90 catches for 1,327 yards and a league-high 17 touchdowns.

New England has built its offense around Tom Brady's passing to Gronkowski and fellow tight end Aaron Hernandez. With slot receiver Wes Welker gone to Denver as a free agent, the Patriots will need Gronkowski at full strength when they open the season on Sept. 8.

One of the moon's mysteries solved: Origin of mascon basins

May 30, 2013 ? A mystery of the moon that imperiled astronauts and spacecraft on lunar missions has been solved by a Purdue University-led team of scientists as part of NASA's GRAIL mission.

Large concentrations of mass lurk on the lunar surface hidden like coral reefs beneath the ocean waves -- an unseen and devastating hazard. These concentrations change the gravity field and can either pull a spacecraft in or push it off course, sealing its fate to a crash on the face of the moon.

"In 1968 these mass concentrations were an unwelcome discovery as scientists prepared for the Apollo landings, and they have remained a mystery ever since," said Jay Melosh, a member of the Gravity Recovery and Interior Laboratory, or GRAIL, science team who led the research. "GRAIL has now mapped where they lay, and we have a much better understanding of how they developed. If we return to the moon, we can now navigate with great precision."

A better understanding of these features also adds clues to the moon's origin and evolution and will be useful in studying other planets where mass concentrations also are known to exist including Mars and Mercury, said Melosh, who is a distinguished professor of earth, atmospheric and planetary sciences and physics.

"We now know the ancient moon must have been much hotter than it is now and the crust thinner than we thought," he said. "For the first time we can figure out what size asteroids hit the moon by looking at the basins left behind and the gravity signature of the areas. We now have tools to figure out more about the heavy asteroid bombardment and what the ancient Earth may have faced."

The team confirmed the standing theory that the concentrations of mass were caused by massive asteroid impacts billions of years ago and determined how these impacts changed the density of material on the moon's surface and, in turn, its gravity field. A paper detailing the results will be published online by the journal Science on May 30.

In addition to Melosh, Purdue team members include Andrew Freed, associate professor of earth, atmospheric and planetary sciences, and graduate students Brandon Johnson and David Blair. Additional team members include Maria Zuber, GRAIL principal investigator and professor at the Massachusetts Institute of Technology; J. Andrews-Hanna of the Colorado School of Mines; S. Solomon of Columbia University; and the GRAIL Science Team.

"The explanation of mascons has eluded scientists for decades," Zuber said. "Since their initial discovery they have also been observed on Mars and Mercury, and by understanding their formation on the moon we have greatly advanced knowledge of how major impacts modified planetary crusts."

The mass concentrations form a target pattern with a gravity surplus at the bulls-eye surrounded by a ring of gravity deficit and an outer ring of gravity surplus. The team found that this pattern arises as a natural consequence of crater excavation, collapse and cooling following an impact.

The team determined that the increase in density and gravitational pull at the bulls-eye was caused by lunar material melted from the heat of the asteroid impact. The melting causes the material to become more concentrated, stronger and denser, and pulls in additional material from the surrounding areas, Melosh said.

The large asteroid impacts also caused big holes into which the surrounding lunar material collapsed. As the cool, strong lunar crust slid into the holes it bent downward, forming a rigid, curved edge that held down the material beneath it and prevented it from fully rebounding to its original surface height. This causes a ring with less gravitational pull because the mass is held farther below the surface, the top of which is what most influences the gravitational signature, he said.

The outer ring of increased gravitational pull comes from the added mass of the material ejected by the initial impact that then piles on top of the lunar surface.

The team combined expertise in specialized computer analysis methods called hydrocodes and finite element codes to create computer simulations that could show the physical changes occurring from microseconds to millions of years. The team analyzed the Freundlich-Sharanov and Humorum mascon basins.

Melosh is a pioneer in adapting computer hydrocodes -- computer programs originally created to analyze the flow of liquids -- to simulate how complex materials move when high-speed collisions occur, like that of a planetary collision. Hydrocodes can be used to study such phenomena on a time scale of microseconds to hours, but are not practical from time scales much longer than that, he said.

Freed is a leader in adapting finite element codes, like those used to study car crashes, to simulate the changes in density of complex materials upon cooling and the evolution of Earth and other planets on the time scale of hours to millions of years.

Using the GRAIL data set, which offers an unprecedented, detailed map of the distribution of masses in the moon, the team was able to put together a picture of how the moon's crust and mantle behaved and the development of the concentrations of mass in the aftermath of large asteroid impacts.

Dan Harmon may return to 'Community'

NEW YORK (TheWrap.com) - Dan Harmon could return to make "Community" weird again.

Well, weirder, at least. A person familiar with the situation told TheWrap that Sony, which produces the show, is considering bringing back Harmon, who created it and was fired after its third season.

Harmon first raised the possibility during a weekend live taping of his Harmontown podcast, according to Hollywookie, which was in attendance.

The site, a self-described "nerd's guide to Hollywood," said Harmon initially said he didn't want the news to leave the room but later said he didn't care who knew.

Harmon was let go amid low ratings, feuding with Chevy Chase (who left last season) and a reputation for running late on scripts.

He was replaced by David Guarascio and Moses Port, who focused more on relationships between the characters and less on the narrative oddities for which Harmon was celebrated. They didn't take out all the weirdness, of course: One show this past season featured puppet versions of the cast.

Despite continued low ratings, the show was picked up for a fifth season earlier this month.

Sony declined to comment, and Harmon and NBC did not immediately respond to requests for comment.

Ferry capsizes in Malaysian river, some missing

KUALA LUMPUR, Malaysia (AP) ? An overloaded ferry capsized after hitting rocks in a remote river in Malaysia's part of tropical, jungle-clad Borneo island on Tuesday, leaving an unknown number of people missing, police said. Some survivors swam ashore, and a search was underway.

The vessel was believed to be carrying much more than its recommended limit of 74 passengers, said Bakar Sibau, a district police chief in Malaysia's Sarawak state.

Bakar said there appeared to be dozens of survivors, but he could not give precise figures. Some people swam ashore, and police divers, fire department officers and villagers nearby were working to find missing passengers.

Bakar said by telephone, "We hope they (the missing) will be OK."

The boat was packed because many people in Sarawak state are heading to their home villages for a harvest festival holiday that Borneo's indigenous tribes will celebrate later this week, Bakar said.

The accident occurred midway through a roughly 130-kilometer (80-mile) journey that usually takes about three hours.

Rivers form the main transportation network for hundreds of thousands of people in sprawling Sarawak. Public concerns about safety, including the enforcement of rules for ferry capacity, have occasionally emerged, but major boat accidents in Sarawak are rare.

Borneo island is divided among three countries: Indonesian territory in the south, two Malaysian states in the north and tiny Brunei on the north coast.

Nanomedicines' impact on patients under the microscope

May 29, 2013 ? A pioneering imaging technique to track the effects of next-generation nanomedicines on patients has been harnessed by a University of Strathclyde academic.

Professor Dr M. N. V. Ravi Kumar and Dr Dimitrios Lamprou, of the Strathclyde Institute of Pharmacy and Biomedical Sciences, believe an advanced form of atomic force microscopy, known as PeakForce QNM, could boost developments in the field of nanomedicines, the encapsulation of potent drugs in tiny particles measuring billionths of a meter in diameter. They described how this detailed imaging approach may also help scientists address growing concerns in the medical world around "nanotoxicology," the build-up of microscopic particles in people's tissues.

Professor Kumar, whose team's research article has been published in the journal PLOS ONE, said: "Nanotechnology's role in drug delivery has the power to transform the way patients are given medicines over the next decade or so.

"In the case of traditional medicines, such as tablets and capsules, only a limited amount of drug -- thought to be around five to 15 per cent for the majority of compounds -- makes it through the gut into patients' blood. The good thing about nanomedicines is that -- unlike as is the case with traditional tablets and capsules -- the drugs are not released in the gut. Instead, nanomedicines are absorbed intact and release the encapsulated drugs directly into bodily tissues, including the blood, offering the possibility to reduce the required dose without compromising the therapeutic effects.

"All medicines are combined with what are known as 'excipients' -- inactive substances which give them the desired bulk and consistency and their role is restricted to the gut. However, the excipients such as polymers, used to formulate the nanoparticle-encapsulating drugs may exhibit undesired effects when they are absorbed through the gut wall. Scientists want to know if nanoparticle-based drugs can have any adverse effects on patients -- and, in particular, if they cause more harm than good in some cases.

"Up until now, little has been known about what happens after nanoparticles circulate throughout the body and if they raise any safety issues for the patient. Previously, it was necessary for nanoparticles to be given a fluorescent or radioactive label, in order to allow scientists to be able to identify and track them. However, by using PeakForce QNM atomic force microscopy we can, for the first time, track where these nanoparticles are going throughout the body after oral administration -- without attaching any fluorescent or radioactive labels and by using the real drug loaded nanoparticles. In particular, we can identify if they are accumulating in specific areas, causing what is known as 'tissue stiffness' -- a condition linked to a variety of diseases, including cancer."

Professor Kumar said it is known that tumours are more rigid -- or stiff -- when compared with surrounding healthy tissues. In addition, recent studies using atomic force microscopy have also shown it is possible to distinguish between non-malignant and malignant tumours cells, on the basis of their relative stiffness.

Professor Kumar added: "The ability of atomic force microscopy to study biomechanical profiles will be an asset in efforts to better understand the difference in tissue stiffness between tissues treated with nanoparticles and those not treated with nanoparticles, how long any associated tissue stiffness persists, and if it disappears quickly. Importantly, it will also help to establish whether or not there is a correlation between the number of nanoparticles present in blood and their accumulation in other tissues. By understanding more about blood stiffness, we will be able to learn more about nanotoxicology generally, and how that affects patients.

"By using atomic force microscopy in this way, we may in future be able to analyse patients' blood and tell if, for example, nanomaterials are accumulating in their livers or arterial walls, causing stiffness which -- if it persists long enough -- may increase their chances of developing diseases.

"Another benefit of nanoparticles is that -- if used at an early stage of the research -- they could save pharmaceutical firms money by reducing the number of drugs that fail at the development stage. These cost savings could then be reinvested into the research and development of new drugs to treat patients."

Surging wildfire forces evacuations in California

SANTA BARBARA, Calif. (AP) ? A surging wildfire forced more than 1,000 people, including Memorial Day campers, to evacuate the mountains of California's Santa Barbara County, officials said.

The fire broke out about 2:45 p.m. Monday in Los Padres National Forest about 15 miles north of Santa Barbara and quickly surged to 700 acres amid winds of about 20 mph, U.S. Forest Service officials said.

The fire was threatening about 50 homes, many of them cabins and vacation rentals, and 50 to 75 residents had evacuated, county fire Capt. David Sadecki said.

Paradise Road and the many campgrounds along it were closed, forcing about 1,000 campers to evacuate, Sadecki said.

A U.S. Forest Service garage and two vehicles had burned, he said.

The American Red Cross set up an evacuation center at Santa Barbara City College and another was set up for horses stalled in the area's many stables.

The National Weather Service said the winds may get worse as night falls, but fire officials said they may also get help from the weather.

"We're hoping the temperatures drop and the humidity rises," Sadecki said.

A huge plume of gray and white smoke rose over the mountains and hovered over Santa Barbara, where many residents were flooding Facebook and Twitter with photos.

The county has issued an air quality warning because of the smoke and wind, advising people to limit time spent outdoors and to avoid outdoor exercise altogether.

(AP) ? The tender, sensual lesbian romance "Blue is the Warmest Color: The Life of Adele" won the hearts of the 66th Cannes Film Festival, taking its top honor, the Palme d'Or.

The jury, headed by Steven Spielberg, took the unusual move of awarding the Palme not just to Tunisian-born director Abdellatif Kechiche, but also to the film's two stars: Adele Exarchopoulos and Lea Seydoux. The three clutched each other as they accepted the award, one of cinema's greatest honors.

"The film had a beautiful French youth that I discovered during the long time filming the movie," said Kechiche at the festival closing ceremony Sunday. "It taught me a lot about the spirit of freedom."

Exarchopoulos stars in the French film as a 15-year-old girl whose life is changed when she falls in love with an older woman, played by Seydoux. The three-hour film caught headlines for its lengthy, graphic sex scenes, but bewitched festival goers with its heartbreaking coming of age story.

"Life of Adele," which premiered at Cannes just days after France legalized gay marriage, was hailed as a landmark film for its intimate portrait of a same-sex relationship.

"The film is a great love story that made all of us feel privileged to be a fly on the wall, to see this story of deep love and deep heartbreak evolve from the beginning," said Spielberg. "The director didn't put any constraints on the narrative, on the storytelling. He let the scenes play as long as scenes play in real life."

Spielberg called Kechiche ("Games of Love and Chance," ''The Secret of the Gran") a "sensitive, observant filmmaker."

Cannes' feting of "Life of Adele" came the same day tens of thousands of protesters marched against the new law Sunday in Paris, and police clashed with some demonstrators. Seydoux called the film "a witness to our time."

"If it can show everyone tolerance, then it's gratifying," said Exarchopoulos.

But jury member Cristian Mungiu, the Romanian director, said current events had no bearing on the decision.

"We were giving awards to cinema," said Mungiu. "Not for political statements."

"Gay marriage is something that many brave states in America are resolving," said Spielberg. "This film actually carries a wry, strong message, a very positive message."

The Palme d'Or, which the jury selected from the 20 films in competition at Cannes, had been viewed as a relatively wide-open race ahead of Sunday's awards. The festival audience embraced the jury's choice, giving Kechiche and his two stars a standing ovation. "Life of Adele" had ranked highest in critics polls at the French Riviera festival.

The jury otherwise spread the awards around.

The Coen brothers' 1960s folk revival "Inside Llewyn Davis" earned the Grand Prix, Cannes' second most prestigious award. The film's breakout star, Oscar Isaac, accepted the award for the Coens, who won the Palme in 1991 for "Barton Fink."

Best actor went to 76-year-old Bruce Dern for Alexander Payne's father-son road trip "Nebraska." Berenice Bejo, the "Artist" star, won best actress for her performance as a single mother balancing a visiting ex-husband and a new fianc? in Asghar Farhadi's "The Past."

The jury prize, Cannes' third top award, went to Kore-eda Hirokazu's gentle switched-at-birth drama "Like Father, Like Son." Mexican filmmaker Amat Escalante took best director for his brutal drug war drama "Heli." Best screenplay went to Zhangke Jia's "A Touch Of Sin," a four-part depiction of the violence wrought by China's economic boom.

Singaporean director Anthony Chen won the Camera d'Or, the award for best first feature, for his "Ilo Ilo." Set during the Asia financial crisis in 1997, the film is about a Singaporean family and its new maid.

Spielberg, whose jury also included Ang Lee, Nicole Kidman and Christoph Waltz, said the group bonded immediately, joking: "I wanted to take them all home with me."

The Palme d'Or can catapult a filmmaker to international renown, and significantly raise the profile of a film. "Life of Adele" was picked up for U.S. distribution during Cannes by IFC's Sundance Selects. Last year's winner, Michael Haneke's "Amour," went on to win best foreign language film at the Oscars, as well as land the rare best picture nomination for a foreign film. 2014 Chevy Spark EV will retail for $27,495 before incentives, hits West Coast freeways in mid-June

Chevy just announced pricing for its 2014 Spark EV. The all-electric compact will retail for $27,495 before incentives, such as a $7,500 federal tax credit and up to $2,500 in state and local credits. All told, you could drive the car home for less than 18 grand, and California residents will net HOV (carpool lane) access to boot. The two-door vehicle ships with a 21kWh battery pack, giving you an estimated range of 82 miles on a full charge. You can also add on DC Fast Charging capability, letting you recharge up to 80 percent in about 20 minutes at select stations. Alternatively, you can charge up using a 240-volt system in about seven hours. The car also includes Chevy's MyLink infotainment platform, the RemoteLink smartphone app and three years of OnStar service. It'll be available at select dealers in California and Oregon by mid-June.

Chipmunks. They're furry, cute and can be rather animated. (And no, we're not talking about Alvin, Simon or Theodore.)

But in an exclusive clip Discovery is sharing with TODAY.com from Sunday's new episode of "North America," viewers will get to see another side to the critters often thought of as adorable little rodents: They're thieving kung-fu masters if you mess with their nuts.

OK, not exactly. The producers of the seven-part series clearly had fun putting together the segment about chipmunks gathering food for winter: As acorns fall from oak trees in a Pennsylvania forest, they sound like bombs dropping. Although ASUS recently delivered the $150 7-inch MeMo Pad and PadFone Infinity combo device, it's been a while since a premium Android tablet graced the lineup. A recent FCC filing from the company, however, reveals an unannounced K005 model equipped with the venerable Snapdragon S4 Pro (APQ8064) SoC clocked at 1.7GHz. Further details are light, but G4Games notes that it reveals AT&T-compatible GSM, CDMA and LTE connectivity and the model number suggests a 10-inch frame. Man shot to death while questioned in Boston probe

ORLANDO, Fla. (AP) ? A Chechen immigrant was shot to death by authorities in central Florida early Wednesday after he turned violent while being questioned about his ties to one of the Boston Marathon bombing suspects, officials said.

Ibragim Todashev, a 27-year-old mixed martial arts fighter, was fatally shot at his Orlando townhouse during a meeting with an FBI agent and two Massachusetts state troopers, authorities said. The agent was taken to a hospital with injuries that were not life-threatening.

Three law enforcement officials, speaking on condition of anonymity, said Todashev had lunged at the FBI agent with a knife. However, two of those officials said later in the day it was no longer clear what had happened. The third official had not received any new information.

The FBI gave no details on why it was interested in Todashev except to say that he was being questioned as part of the Boston investigation. However, two officials briefed on the investigation said he had implicated himself as having been involved in a 2011 triple-slaying in the Boston suburb of Waltham that authorities believe may have been connected to one of the men behind the bombings.

Several of Todashev's former roommates who were questioned said that he knew the older bombing suspect, Tamerlan Tsarnaev, from mixed martial arts fighting in Boston and that the FBI was asking about him.

Public records show Todashev lived in Watertown, Mass., just outside Boston, last year.

Tamerlan Tsarnaev, an aspiring boxer, was killed in a shootout with police days after the April 15 bombings. His younger brother, Dzhokhar, survived and is charged with carrying out the attack that killed three people and wounded more than 260. He's also charged in the slaying of an MIT police officer days later.

Investigators have been trying to establish the scope of the Boston bombings plot. Authorities in Massachusetts said they would investigate whether Tamerlan Tsarnaev had any connection to the unsolved 2011 deaths in Waltham, where three men were found in an apartment, their throats slit and marijuana sprinkled over their bodies. One of the victims was a boxer and a friend of Tsarnaev's.

Two officials who were briefed on the investigation said Todashev made statements implicating himself as being involved in the 2011 Waltham slayings while he was being interviewed by the FBI and Massachusetts state police. Neither of the officials, one of whom had earlier told The Associated Press there was no new information on Todashev lunging at the agent, knew whether Todashev had also implicated Tamerlan Tsarnaev in the killings. The two people, a federal law enforcement official and a Massachusetts state official, were not authorized to release details of the investigation and spoke on condition of anonymity.

Neither official was sure of the extent of Todashev's supposed involvement.

According to friends, Todashev had lived on and off with other Chechens in the Orlando suburb of Kissimmee and had moved to Orlando more recently.

"He's a regular guy, nothing wrong," Saeed Dunkaev said.

Police records, however, suggest he had a hot temper, with arrests in a road rage incident and, more recently, in a fight over a parking space.

Muslin Chapkhanov, another former roommate, said Todashev knew the older Tsarnaev brother.

Todashev "was living in Boston and I think he trained with him," Chapkhanov said.

Former roommate Khusen Taramov said the FBI was asking questions about a conversation that Todashev had with the elder bombing suspect a month before the Boston attack.

The Tsarnaev brothers have roots in the turbulent Russian regions of Dagestan and Chechnya, which have become recruiting grounds for Islamic extremists. Investigators have said the brothers carried out the bombings in retaliation for the U.S. wars in Iraq and Afghanistan.

An FBI team was dispatched from Washington to review the shooting, standard procedure in such cases.

Todashev was arrested earlier this month on a charge of aggravated battery after getting into a fight over a parking spot with two men ? a father and son ? at an Orlando shopping mall. The son was hospitalized with a split lip and several teeth knocked out, according to a sheriff's report. Todashev claimed self-defense.

"Also by his own admission Todashev was recently a former mixed martial arts fighter," the arresting deputy said in his report. "This skill puts his fighting ability way above that of a normal person."

Todashev was released on $3,500 bail after his May 4 arrest. His attorney, Alain Rivas, didn't immediately respond to a call for comment Wednesday.

Todashev was also arrested by Boston police in 2010 after a road rage incident. Witnesses told police that he argued with two other drivers and cut them off with his vehicle. According to a police report, he yelled, "You say something about my mother, I will kill you."

Mohammad Heidari, accused of passing security-related information and secrets to Israeli Mossad agents in exchange for money, and Kourosh Ahmadi, accused of gathering information for the U.S. Central Intelligence Agency, were hanged at dawn, it said.

The sentence for their execution was handed down by Tehran's Revolutionary Court and confirmed by the country's Supreme Court. The report did not say when the pair were arrested nor when their trial took place.

Iran has in the past said it had successfully detected and dismantled spy networks operating inside the country. It has blamed the assassinations of scientists associated with its disputed nuclear programme on Western spy agencies, especially Mossad.

The United States has denied any role in the killings. Israel has not commented.

The executions were held as Iran prepares for a June 14 presidential election.

Iran's electoral watchdog said on Monday it would bar physically feeble candidates from running for president, in an apparent hint that it could disqualify 78-year-old former President Akbar Hashemi Rafsanjani from the race.

Rafsanjani, if he is allowed to run, would be a significant challenge to conservative hardliners who are ultra-loyal to Supreme Leader Ayatollah Ali Khamenei and who otherwise dominate the field for the presidential election.

The wily, pragmatic cleric, who has often been close to the heart of power since Iran's 1979 Islamic Revolution, shook up the election contest earlier this month when he joined the race.

But the Guardian Council, a conservative body of clerics and jurists that vets all candidates, may disqualify him, along with Esfandiar Rahim Mashaie, a close ally of President Mahmoud Ahmadinejad, who also registered to run at the last moment.

"If an individual who wants to take up a high post can only perform a few hours of work each day, naturally that person cannot be confirmed," Guardian Council spokesman Abbas Ali Kadkhodai said on Monday, according to the ISNA news agency.

Kadkhodai did not name Rafsanjani. The council is due to present a final list of approved candidates on Tuesday to the Interior Ministry, which then has two days to announce it.

Hardline legislators demanded last week that Rafsanjani and Mashaie be banned from running.

Rafsanjani earned hardliners' ire for criticising the crackdown on opposition protests after Ahmadinejad was re-elected in 2009 in a vote that reformists said was rigged.

Conservatives are suspicious of Mashaie, saying he holds an unorthodox view of Islam and seeks to sideline clerical rule.

Lawmaker Ali Motahari, who is close to Rafsanjani, told reporters on Monday that a rejection of Rafsanjani's candidacy would put the very principles of the state under question, "because Hashemi (Rafsanjani) had the biggest role in the Islamic revolution", according to the ILNA news agency.

He derided the idea that Rafsanjani was too old, saying: "How do they know whether Hashemi can run the country or not?"
Motahari also suggested that Khamenei could step in to push the Guardian Council to approve Rafsanjani's candidacy if it is initially rejected. The body re-qualified two reformist presidential candidates in 2005 after Khamenei intervened.

Parliament proposed age restrictions for presidential candidates last year, but dropped the measure after opposition from the Guardian Council.

Many Iranians would view Rafsanjani's disqualification on the basis of age as a political pretext - and it might look awkward for Khamenei, who reinstated Rafsanjani as head of the Expediency Council, an advisory body, in 2012.

"It is hard to fathom a justification for Rafsanjani's disqualification," said Farideh Farhi, an Iran analyst at the University of Hawaii. Shares grind higher, yen rebounds on minister's remarks

NEW YORK (Reuters) - Global equity markets mostly rose on Monday, driven higher by a flurry of merger and acquisition activity, while a recent tumble in the yen against the dollar halted after Japan's economy minister suggested the currency might have weakened enough.

Major American and European stock indices are up double digits - the U.S. benchmark S&P 500 index is almost 17 percent higher so far this year - and investors still see better returns ahead in equities, even as Wall Street closed slightly lower.

Deals such as Yahoo's $1.1 billion bid for blogging service Tumblr indicate companies still are seeking to grow through acquisitions despite record high share prices, a bullish sign for stocks. Yahoo rose 0.23 percent to $26.58.

In another deal, generic drugmaker Actavis Inc. , itself the subject of takeover speculation, said it would buy specialty pharmaceutical company Warner Chilcott Plc for $5 billion in stock.

Actavis rose 1.32 percent to $127.15, while Warner Chilcott gained 2.03 percent to $19.60.

U.S. stocks fell after modest gains earlier in the session on a day with no economic data and little news or a catalyst to drive prices much in either direction, said Tim Ghriskey, chief investment officer at Solaris Group in Bedford Hills, New York.

"There are people scared by the sharpness and the length of this rally, which is totally understandable, but there are still those who are afraid to not invest and miss the rally," he said.

The Dow Jones industrial average <.dji> closed down 19.12 points, or 0.12 percent, at 15,335.28. The Standard & Poor's 500 Index <.spx> fell 1.18 points, or 0.07 percent, to 1,666.29. The Nasdaq Composite Index <.ixic> shed 2.53 points, or 0.07 percent, at 3,496.43.

Major indices elsewhere mostly rose. MSCI's all-country world equity index <.miwo00000pus> rose 0.43 percent to its highest since June 2008. MSCI's emerging markets index rose 0.25 percent, but Mexico's IPC index <.mxx> fell 1.74 percent, beaten lower by the weak outlook for the country's leading shares.

European shares hit five-year highs, boosted by strength in German stocks and a travel sector lifted by a surge in Ryanair after it reported better-than-expected earnings for the past year. Ryanair rose 6.87 percent to a record 6.765 euro.

Britain's benchmark FTSE 100 <.ftse> index rose to its best closing level since late 2000, while the FTSEurofirst-300 index of leading European shares <.fteu3> rose 0.31 percent to close at 1,252.09.

The Japanese economy minister, Akira Amari, said the yen's excessive strength had largely corrected and further weakness could damage Japan's economy.

Analysts, however, said any sharp dip in the dollar against the yen was a buying opportunity as Tokyo was committed to easier monetary policy. While the dollar fell sharply on Amari's comments and remained down on the day, it was off the session low.

The dollar was last 0.64 percent lower at 102.26 yen, having hit a low of 102.19. Last Friday, the dollar reached a high of 103.30 yen.

The euro gained 0.59 percent against the dollar to 128.886.

Gold gained about 2 percent after a roller coaster session in which it lurched $35 an ounce higher to snap seven consecutive days of losses, with traders citing a wave of pent-up short-covering.

Short sellers buy a borrowed security and immediately sell it in the hope of buying it back at a lower price to pay the lender. When prices are not near the agreed "strike" price, short-sellers are forced to buy, pushing prices higher.

Gold is down 17 percent for the year. Hedge funds and other major commodity speculators pulled $1.4 billion from the U.S. gold futures market in the week to May 14, Reuters calculations of data from the Commodity Futures Trading Commission show.

Spot gold prices rebounded $35.96 on Monday, to $1,394.60 an ounce after slipping to $1,338.95 its weakest since April 16.

The beginning of the end of the Fed's massive bond-buying program might come sooner than many investors think if recent gains in the U.S. labor market do not prove fleeting.

U.S. government debt prices slipped after an early rebound from last week's sell-off as the dollar weakened against the yen. The benchmark 10-year U.S. Treasury note was down 3/32 in price to yield 1.9629 percent.

Brent crude traded near break-even, weighed by ample supplies, weaker demand for fuel and a strong dollar.

Brent crude for July was up 16 cents to settle at $104.80 a barrel. U.S. crude rose 69 cents to settle at $96.71.

Money tangle: The IRS and its tea party tempest

WASHINGTON (AP) ? The Internal Revenue Service is feeling the sort of heat that targeted taxpayers feel from the tax agency. It's the sense that a powerful someone is breathing down your neck.

Republicans in Congress are livid with the IRS over its systematic scrutiny of conservative groups during the 2010 and 2012 elections. Democrats agree that something must be done. President Barack Obama also isn't at all happy with the tax collectors.

That kind of commonality in Washington is about as rare as a budget surplus. So expect a bumpy ride for the IRS, unloved in the best of times, as a Justice Department criminal investigation and multiple congressional inquiries try to get to the bottom of it all.

A look at the matter:

IN BRIEF

The central issue is whether IRS agents who determine whether nonprofit organizations have to pay federal income taxes played political favorites or even broke the law when they subjected tea party groups and other conservative organizations to special scrutiny.

Also foremost in the concerns of Congress: Why senior IRS officials, for many months, did not disclose what they had learned about the actions of lower-level employees despite persistent questions from Republican lawmakers and howls from aggrieved organizations.

WHY IT MATTERS

The IRS is expected to be pesky, even intimidating, to miscreants, but at all times politically neutral. Nonpartisanship is the coin of its realm, perhaps more so than in any other part of government.

"I will not tolerate this kind of behavior in any agency but especially in the IRS, given the power that it has and the reach that it has into all of our lives," Obama said in ousting the agency's acting chief, Steven T. Miller.

On Thursday, on the eve of House hearings at which Miller has been called to testify, the president named Daniel Werfel, a senior White House budget official, to take charge of the agency temporarily.

IRS actions in the period covering the 2010 congressional elections and the early going of the 2012 presidential campaign have tattered the perception that the agency is clean of political leanings. Whether that was also the reality remains to be discovered.

A report by the Treasury Department's top investigator for tax matters found no evidence that sheer partisanship drove the targeting. But the watchdog disclosed Friday that he is still investigating. His report faulted lax management for not stopping it sooner.

It's a sensitive time for the agency's professionalism to be in doubt because the IRS soon will loom even larger in people's lives. It's to be the enforcer of the individual mandate to carry insurance under Obama's health care law, itself an object of suspicion for many conservatives. To the right, that's insult upon injury from the left.

WHAT WOULD MAKE IT MATTER EVEN MORE

Any effort from top levels of the administration or political operatives to manipulate the IRS for campaign purposes would put the scandal in the realm of Nixonian skullduggery.

The public record as it is known does not show interference.

No ties to anyone outside the IRS have been discovered. At the same time, early IRS assurances that high-level people inside the agency did not know what was going on have been contradicted by evidence that the head of the agency's tax-exemption operation and later its deputy commissioner were briefed about it and did not tell Congress.

RED-FLAG WORDS

To qualify for exemption from federal income taxes, organizations must show they are not too political in nature to meet the standard. In the cases in question, applications that raised eyebrows were referred to a team of specialists who took a much closer look at a group's operations. That's normal.

But in early 2010, IRS agents in the Determinations Unit began paying special attention to tax-exempt applications from groups associated with the tea party or with certain words or phrases in their materials, according to the IRS inspector general's report. That's not normal.

The red-flag keywords came to include "Patriots," ''Take Back the Country" and "We the People."

That August, agents were given an explicit "be on the lookout" directive for "various local organizations in the Tea Party movement" that are seeking tax-exempt status. Such organizations saw their applications languish except when they were hit with lots of questions, some of which the IRS was not entitled to ask, such as the names of donors.

In June 2011, after the congressional elections, Lois G. Lerner, in charge of overseeing tax-exempt organizations, learned of the flagging and ordered the criteria to be changed right away, the inspector general said. The new guidance was more generic and stripped of any explicit partisan freight. But it did not last.

In January 2012, the screening was modified again, this time to watch for references to the Constitution or Bill of Rights, and for "political action type organizations involved in limiting/expanding government."

The Constitution and Bill of Rights are touchstones for liberals, too. But in modern politics, they've been appropriated as rallying cries of conservatives and libertarians. Finally, that May, such flagging ended.

Altogether, specialists reviewed a variety of potentially too-political applications, presumably covering the liberal-conservative spectrum. But fully one-third of the cases were of the tea party-patriot variety. During the height of the flagging, the inspector general says, all applications fitting the conservative-focused criteria went to the specialists while others that should have stirred concern did not.

In short, if you were with the tea party, you were guaranteed a close second look and almost certainly months more of delay. If you were leading a liberal activist group, maybe yes, maybe no.

ON THE RECEIVING END

"Dealing with this was like dealing with tax day every day for 2? years," says Laurence Nordvig, executive director of the Richmond Tea Party in Virginia. "Like your worst audit nightmare."

His group applied for tax-exempt status in December 2009 and finally got it in July 2012.

Tom Zawistowski applied for the tax exemption for his group, the Ohio Liberty Coalition, in June 2010 when the flagging was gathering steam. He got it in December 2012, after the presidential election.

The IRS asked him for the identity of the group's members, times and location of group activities, printouts of its website and Facebook pages, contents of speeches and the names and credentials of speakers at forums. He said the IRS also audited his personal finances and his wife's.

"The intent of this was to hurt the ability of tea party groups to function in an election year," he said.

An Associated Press analysis of 93 "tea party" or "patriot" groups found that most were shoestring operations, with only two dozen raising more than $20,000 a year.

FIVE-OH WHAT?

If the IRS merely rolled over and played dead when it got an application for a tax exemption, the government would be even more broke than it is and big money would have an even more pernicious grip on campaigns.

The IRS knows better than most that politically driven organizations, out to elect and defeat candidates, can masquerade as "social welfare" or other charitable entities under the tax-exempting articles of Section 501 (c) of the tax code.

Or they can align themselves with one, allowing unlimited donations to be raised and the identities of the contributors to stay secret as long as the nonprofit entities don't go too far in overt politicking.

In recent years, advocacy groups have paired their nonprofit arms with "super" political action committees, moves that took hold after a series of court rulings ? including the Supreme Court's 2010 Citizens United decision ? loosened the rules on money in politics.

The rulings gave rise to such pairings as the American Crossroads super PAC with its Crossroads GPS nonprofit on behalf of Republicans in the 2012 campaign, and the Priorities USA Action super PAC with its own nonprofit arm, for Obama's benefit.

Section 501 (c) (3) can be the most lucrative financially for organizations because in addition to conferring tax-exempt status, it allows donations to qualifying groups to be tax deductible.

Section 501 (c) (4) doesn't permit tax-deductible donations but gives groups more latitude to lobby and to dabble more directly in political campaigns as long as "social welfare" remains their primary mission. They can also keep their donors secret, a big benefit over more blatantly political super PACs.

It's all complex, squishy and in some ways subjective, so it might not come as a shock that the IRS would look for shortcuts such as political buzzwords and slogans when deciding what a group is really up to. But the record as yet known does not show that the scrutiny cut both ways.

In congressional testimony about the discredited IRS actions, Attorney General Eric Holder said there is good reason to take a skeptical look at some Section 501 applications but "it has to be done in a way that does not depend on the political persuasion of the group."

BY THE NUMBERS

The inspector general's office reviewed 296 tax-exempt applications that had been flagged as potentially too political. Of them, 108 were ultimately approved, 28 were withdrawn by the applicant, none had been rejected and 160 were still open in December 2012, some languishing for more than three years.

STONEWALLING?

Hearing complaints of IRS harassment from constituents, lawmakers began asking a lot of questions of the agency starting in mid-2011. They got a lot of answers ? just not answers revealing what was going on.

In multiple letters, some as long as 45 pages, as well as in meetings and congressional hearings, senior IRS officials laid out in painstaking detail the process of checking tax-exempt applications but did not disclose what they had come to learn of the flagging.

Miller, for example, was told by staff in May 2012 about the inappropriate screening but did not pass that on in communications with inquiring members of Congress or in his appearance two months later with the House panel most concerned about the reports.

Lois G. Lerner, in charge of overseeing tax-exempt organizations at the IRS, was briefed about the screening a year earlier and ordered an end to explicit tea party-type flagging. But she did not tell lawmakers about that when asked about the constituent complaints.

ABOUT THAT SKULLDUGGERY

A number of presidents or their operatives have tried to twist the IRS against "dissidents" or political opponents. Presidents Franklin Roosevelt, Dwight Eisenhower and John Kennedy are among them.

President Richard Nixon, though, surely takes the cake here.

The Senate Judiciary Committee cited his IRS manipulations, including his pursuit of those on his "enemies list," in the articles of impeachment accusing the president of high crimes and misdemeanors in the Watergate scandal and of actions "subversive of constitutional government."

Article 2, Abuse of Power, said: "He has, acting personally and through his subordinates and agents, endeavored to obtain from the Internal Revenue Service, in violation of the constitutional rights of citizens, confidential information contained in income tax returns for purposes not authorized by law, and to cause, in violation of the constitutional rights of citizens, income tax audits or other income tax investigations to be initiated or conducted in a discriminatory manner."

Nixon resigned after it became clear that a Senate impeachment trial would drive him from office.
